Mechanics Liens on SBA Collateral: Priority and Timing Gaps
A mechanics lien can outrank a mortgage recorded before it, and the filing window can stay open after you fund. What to check, and when to check it again.

Most liens on SBA collateral behave the way a lender expects. They are recorded on a date, they take a position based on that date, and a search either finds them or it does not. Mechanics liens are the exception, and the exception matters most on exactly the files SBA lenders see often: a borrower who just finished a buildout, a building that was renovated for the business, or a construction project that reached completion shortly before closing. The lien that dates backward
Relation back is the mechanism. In many states a mechanics lien takes its priority date not from the day it was recorded but from an earlier point, commonly the start of work on the project or the first delivery of materials, and in some states from the recording of a notice of commencement. The filing deadline itself runs from the last work performed, and it is measured in months rather than days.
Put those two rules together and the consequence for a lender is direct. A search that comes back clean on the day of closing does not rule out a lien recorded six weeks later that claims a position ahead of your mortgage. The specific rule, the deadline, and the priority outcome are all state law, and they vary considerably, so the analysis belongs to counsel in that state. What the record can tell you is whether work was recently done and whether anything has been filed so far.
What to check in the record
Project filings come first. Where the state uses them, a notice of commencement or similar instrument sets the clock and names the parties. Construction loan mortgages and modifications belong in the same review, since they establish what was being financed and when.
Liens and releases are the second category. A recorded mechanics lien states a claimant, an amount, and usually a description of the work, and the important companion documents are the releases, partial waivers, and any suit filed to foreclose the lien. A lien with no release and no suit within the statutory period may have expired, and that determination is a legal one rather than something the index announces.
The blind spot is what has not been recorded yet. Unpaid invoices, a subcontractor preparing to file, and preliminary or pre-lien notices sent to the owner rather than to the recorder all sit outside the land records. A clean search reflects the record as of its date and does not prove no claim exists, which is the same limit described in what an SBA title search cannot find.
Ordering around a project
Send the parcel and legal description, the borrower and entity names, the general contractor name if you have it, and the dates work was performed. Contractor names matter because a lien indexed against a name nobody searched is a lien nobody finds, and a project run through an affiliate is common on owner occupied deals.
Then time it twice. Once early, so a recorded lien can be cleared, bonded around, or negotiated before funding. Once again close to closing, since a report is accurate as of its own date, which is the reason pre-closing title updates exist as a separate product. Both searches together still leave the relation back window open, and that gap is managed with tools rather than with records: lien waivers from every contractor and material supplier, a title policy with the appropriate endorsements, and a holdback where the numbers justify one.

Treat recent work on the collateral as a specific underwriting question rather than a background detail. Search the record, get the waivers, and update the search near funding, because the one thing a mechanics lien can do that other liens cannot is arrive late and still get in front of you.
